Please read these Terms of Service carefully before using the FaceFacts application. By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About FaceFacts
FaceFacts is a mobile application developed and operated by ABCD Wendt Limited, a company registered in New Zealand. The App provides AI-powered analysis of skincare and personal care product ingredients to help users make informed purchasing decisions.
2. Acceptance of Terms
By downloading, installing, or using the App, you confirm that you are at least 13 years of age, have read and agree to these Terms, have read and agree to our Privacy Policy, and have the legal capacity to enter into a binding agreement.
3. Important Disclaimer - Not Medical Advice
IMPORTANT: FaceFacts provides general information about cosmetic and skincare ingredients for educational and informational purposes only. The App is NOT a substitute for professional medical, dermatological, or health advice. Nothing in the App should be construed as medical advice or used to diagnose, treat, cure, or prevent any skin condition or disease.
Always consult a qualified dermatologist or healthcare professional before changing your skincare routine if you have a skin condition. Always check the physical product label for the most accurate and up-to-date ingredient information, as formulations change. We are not responsible for any reactions, harm, or loss resulting from reliance on information provided by the App.
4. AI-Generated Content
Ingredient analysis provided by FaceFacts is generated using artificial intelligence (the Anthropic Claude AI API). While we strive for accuracy, AI-generated content may contain errors, omissions, or outdated information. You should not rely solely on AI-generated analysis for health or safety decisions.
5. Subscriptions and Payments
Free Tier
The free version of FaceFacts includes 3 ingredient scans per day. Free users will see advertisements served by Google AdMob.
Pro Subscription
FaceFacts Pro is available as:
- Monthly: USD $4.99 per month
- Annual: USD $39.99 per year (approximately 33% saving)
Pro subscribers receive unlimited scans, access to the Compatibility Checker and Compare Ingredients features, and no advertisements.
Billing
- Subscriptions are billed through Apple (App Store) or Google (Google Play)
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Manage and cancel your subscription through your App Store or Google Play account settings
- We do not offer refunds except as required by law or Apple/Google refund policies
6. Acceptable Use
You must not use the App for any fraudulent or unlawful purpose, attempt to reverse-engineer or decompile the App, use automated tools to scrape data, attempt to gain unauthorised access to our systems, or resell or sublicense access to the App.
7. Intellectual Property
All content, features, and functionality of the App, including the FaceFacts name, logo, design, and software, are owned by ABCD Wendt Limited and protected by intellectual property laws. You are granted a limited, non-exclusive licence to use the App for personal, non-commercial purposes only.
8. Third-Party Services
The App integrates with Anthropic, Google AdMob, RevenueCat, Open Beauty Facts, and INCIDecoder. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, ABCD Wendt Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including skin reactions to products, reliance on ingredient analysis, loss of data, or interruption of service.
Our total liability shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, or NZD $100, whichever is greater.
10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the App will be uninterrupted or error-free, that information will be accurate or current, or that the App will meet your specific requirements.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms. To cancel a subscription, do so through your App Store or Google Play account settings.
12. App Store and Google Play Terms
Your use of the App is also subject to the terms of the platform through which you downloaded it. Apple is not a party to these Terms and has no warranty obligations with respect to the App.
13. Governing Law
These Terms are governed by the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the courts of New Zealand for any disputes arising from these Terms.
14. Changes to These Terms
We may modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
